About this book

This Encyclopedia covers the developments of a wide variety of constitutional law topics, taking a global perspective. It discusses these constitutional law topics in detail and provides analyses of their transformation from traditional structures to the current phenomena. The volumes focus on constitutional topics as changing phenomena, offer in-depth comparative analyses at the national, regional and universal level, consider the international context, and reveal the cultural, historical and social relation between topics. Specifically, the volumes consider regional perspectives from legal cultures in Europe, North America, Latin America, Asia , Africa, and Australia. They discuss and provide examples of the common features and differences of specific legal phenomena such as constitutional justice, fundamental rights protection, and institutional systems, in the various countries and legal systems discussed. In the analyses of these topics, the chapters and volumes take into accountthe historical, sociological and philosophical context. 

Constitutional law in the world is characterized both by the emergence of universal principles and the consolidation of regional particularities due to specific cultural orientations, historical factors and political impact. In the last decades, constitutional law has undergone profound changes; traditional concepts which seemed to be firmly established have proven to be no longer appropriate for the new developments which are characterized by growing internationalization, dynamic transfers of legal ideas by a manifold transnational “dialogue”, integration processes, and new challenges resulting from technological progress.

About the editors

Prof. Dr. Dres. h.c. Rainer Arnold, was appointed, in 1978, at the University of Regensburg, holder of the Chair of Public Law, in particular Comparative Law, EC Law, Economic Administrative Law, Public Law of Foreign Countries and  in 1999 also holder of the Jean Monnet Chair of EC Law. He was awarded in 2008 holder of the Jean Monnet Chair ad personam “Legal Relation of the EU with Central, Eastern and South-Eastern Europe”. In 2000 he was nominated a permanent Visiting Professor (Hostující Profesor) at Charles University Prague. From 2002 – 2012 he was director of the German Studies Program DSG at Moscow State University Lomonosov. He was elected Corresp. Member of the Academy of Sciences of Bologna (2002), Membre associé (2002) and in 2015 ordinary member of the Académie internationale de droit comparé (2002) as well as Fellow of the European Law Institute (2010). He was a Fernand Braudel Fellow and repeatedly Visiting Fellow at the European University Institute, Florence, as well as Visiting Professor at the Universities Paris I, Paris II, Strasbourg, Toulouse, Aix-en-Provence, Trento, Rome La Sapienza, Bologna, Lisbon, Santiago de Chile, etc. He was awarded Dr. h.c. by the University of Law of the National Academy of Sciencs of the Ukraine, Kiev, (2012) of the University Alba Iulia “1st of December 1918”, Romania (2013), and of the University of Pitesti, Romania (2014). His research fields and numerous international publications focus on Comparative Constitutional Law, EU law, and Human Rights.
