Zusammenfassung
Die ökonomische Analyse des Rechts hat sich in den letzten zwanzig Jahren zu einem weitgespannten Wissenschaftszweig entwickelt. Wenn auch heute die Fülle der Literatur nur noch schwer übersehbar ist, beruht ihr Programm dennoch auf einigen wenigen Annahmen und Postulaten, die Ronald H. Coase bereits 1960 in seinem Aufsatz über das Problem der sozialen Kosten formuliert hat. Coase zeigte anhand vieler Beispiele aus der Rechtsprechung zum Common Law, daß die Richter bei der Fortbildung des geltenden Rechts, bei der Konstruktion von Abwehrrechten oder Schadensersatzpflichten, die den Gebrauch von Ressourcen beeinflussen, sich häufig von dem Gedanken leiten ließen, den Gesamtertrag der Ressourcen zu erhöhen. In seinen Schlußfolgerungen plädierte er dafür, bei der Wahl zwischen verschiedenen sozialen Arrangements »die Wirkungen einer vorgeschlagenen Regeländerung zu untersuchen und den Versuch einer Entscheidung zu unternehmen, ob alles in allem die neue Sachlage besser oder schlechter ist als der Ausgangspunkt«.1 In diesem Zitat kommen einige, später präzisierte Positionen der ökonomischen Analyse des Rechts zum Ausdruck, die weder für die Rechtswissenschaft noch für die Wirtschaftswissenschaft selbstverständlich sind.
