Südafrika: Demokratisierung als Prozeß der Verfassunggebung?

Zusammenfassung

Der Übergang zur Demokratie in Südafrika — nach jahrhundertelanger Diskriminierung der schwarzen Mehrheit und über 40 Jahren Apartheid — ist von vielen Beobachtern mit Staunen zur Kenntnis genommen oder gleich unter der Rubrik “Wunder” eingeordnet worden. Das Verständnis des Transitionsprozesses und der Verfassungsdiskussion ist nur möglich, wenn man die verschiedenen Dimensionen des Apartheid-Konflikts berücksichtigt. Er war ein durch ein hohes Maß an institutionalisierter Gewalt gekennzeichneter Konflikt zwischen Weiß und Schwarz1, analog dazu zwischen reich und arm. Gleichzeitig war es auch ein politischer Konflikt um Macht sowie zwischen verschiedenen Ideologien. Hinzu kommen die regionale und internationale Konfliktdimension.
