Summary
There are increasing social pressures for a better environment and these are giving rise to an increasing body of case and statutory law related to waste disposal, pollution and health. Some of the inadequacies of past and present legislation and administration are described. The legal and environmental framework for the most common subsurface waste disposal methods is discussed. Some problem areas are highlighted. Of particular hindrance to satisfactory waste disposal and environmental protection is the fragmentary nature of the legislation and administration in Australia. The importance for legislation and administration of seeing waste disposal and its environmental interaction as a continuous process is emphasised. The various types of legal controls, both governmental and private, are described for Australia and to a lesser extent the U.S.A. Legal principles associated with private controls are highlighted and subsurface property right differences between U.S.A. and Australia are noted. Some trends in statutory and civil law are indicated for both countries and several amendments to Australian legislation are suggested.

Les pressions de la société pour un meilleur environment augment et elles sont en train de donner lieu à un nombre croissant de règlements et de lois relatifs au stockage de déchets, à la pollution et à la santé. On décrit quelques inadéquations de la législation et de l'administration passées et actuelles. On discute le cadre législatif et environmental des méthodes de stockage souterrain les plus courrantes. Quelques problèmes dans certaines régions sont soulignés. La nature fragmentaire de la législation et de la règlementation en Australie est un obstacle entre autres pour satisfaire à la fois au stockage des déchets et à la protection de l'environment On insiste sur le fait que loi et règlementation voient les stockages et leurs influences sur l'environment comme un conflit perpétuel. On décrit les différents contrôles légaux, à la fois gouvernementaux et privés, en Australie et de façon moindre aux U.S.A. On met en lumière les principes législatifs associés à des contrôles privés et les différences du droit à la propriété de la subsurface entre les U.S.A. et l'Australie. On indique quelques tendances de la législation pour les deux pays et on propose quelques amendements à la législation australienne.
