Standards of competence in demented people

Abstract

Both the concept of competence to consent and, much more, its assessment are in a state that have to be developed much more and empirically tested with regard to validity, practicability, acceptability, and even ethical consequences. Hence, it seems premature to speak of “standards”. Therefore, I proposed only guidelines on dimensions of mental functions relevant to competence to consent and on their assessment according to illustrated criteria.

Sia il concetto di competenza al consenso (di capacità di consentire) e, ancor più, delle modalità della sua valutazione devono essere ulteriormente sviluppati e testati empiricamente riguardo a validità, realizzabilità, accettabilità e persino conseguenze sul piano etico.

Sembra pertanto prematuro parlare di “standards”. Perciò ho proposto solo linee guida riguardanti le caratteristiche dimensionali e le modalità di valutazione delle funzioni cognitive indispensabili per la competenza al consenso.
