Zusammenfassung

Die föderale Staatsorganisation ist neben der horizontalen Gewaltenteilung das zweite Kernmerkmal der amerikanischen Verfassungsinstitutionen. Dabei etabliert die amerikanische Verfassung einen Bundesstaat dualen Typs, dessen Charakter sich im Laufe des 20. Jahrhunderts durch Prozesse der Zentralisierung und eine zunehmende Verschränkung der Finanzbeziehungen nachhaltig verändert hat. Dieses Kapitel analysiert neben der Entstehung des amerikanischen Bundesstaats den Wandel der Handlungsspielräume beider Ebenen in der Normsetzung und Implementation.
