Zusammenfassung

Das Konzept der Transitional Justice bezeichnet das ganze Spektrum der Bemühungen um eine Aufarbeitung von Menschenrechtsverbrechen. Es hat seit seiner Entstehung eine immense Ausweitung der damit verbundenen Ansprüche und Ziele erfahren, was daran liegt, dass es in mehrfacher Hinsicht unpräzise ist. Weder der Ausdruck „justice“ noch der Ausdruck „transitional“ sind noch in der Lage, das Instrumentarium von Transitional Justice adäquat zu erfassen. Dieser Problematik widmet sich diese konzeptionelle Auseinandersetzung. Sie beginnt mit einer einführenden Vorstellung verschiedener Definitionen und einem kurzen Abriss der Geschichte des Begriffs. Anschließend werden seine beiden Bestandteile „justice“ und „transitional“ seziert und eine Reihe von Bedeutungsfacetten und -erweiterungen diagnostiziert. Der Beitrag bietet darüber hinaus einen Überblick über die Kritik am Konzept der Transitional Justice und diskutiert, ob das Konzept beibehalten oder aufgegeben werden sollte.
