Abstract

On December 13, 2010, Judge Henry E. Hudson of the United States District Court for the Eastern District of Virginia struck down the individual mandate portion of the Affordable Care Act (ACA) as going beyond the scope of Congress’s power under the Commerce and Necessary and Proper Clauses. He also severed the individual mandate from the rest of the act and left the balance of the law standing.
