Doppelte Staatsangehörigkeit und Auslandswahlrecht in Kolumbien

Zusammenfassung

Der Beitrag geht von der Beobachtung aus, dass zahlreiche Staaten Lateinamerikas in den letzten Jahrzehnten dazu übergingen, die Grenzen nationaler Zugehörigkeit neu zu definieren und die Möglichkeit zur Führung von mehreren Staatsangehörigkeiten konstitutionell zu verankern. Darüber hinaus gestatten auch immer mehr Länder dieser Region ihren dauerhaft im Ausland lebenden Staatsbürgern die Teilnahme an demokratischen Prozessen, insbesondere an nationalen Wahlen. Der vorliegende Beitrag betrachtet diese Entwicklungen am Beispiel Kolumbiens und geht den Gründen für diese symbolische und praktische Inklusion der Emigranten nach. Dem vorangestellt sind einige theoretische Überlegungen zur Auswirkung internationaler Migration auf etablierte Konzepte staatlicher Zugehörigkeit und demokratischer Partizipation. Abschließend werden die geringe Wahlbeteiligung der kolumbianischen Migranten und mögliche Erklärungsansätze derselben diskutiert.

    Es sei darauf verwiesen, dass beide Begriffe im wissenschaftlichen Diskurs teilweise auch weniger strikt getrennt oder gar synonym verwendet werden (vgl. bspw.: Hammar 1989; Aleinikoff und Klusmeyer 2001; Spiro 2007).

    Der Begriff ‚irregulärer Migrant‘ stellt auf die Tatsache ab, dass die betreffende Person keinen formaljuristisch gültigen Aufenthaltstitel besitzt, dass dieser abgelaufen ist oder dass ihr Visum nicht dem tatsächlichen Zweck des Aufenthalts entspricht (bspw. Arbeitsaufnahme mit einem Touristenvisum). Im Sprachgebrauch staatlicher Institutionen und in der öffentlichen Diskussion ist in diesem Zusammenhang oft von ‚illegalen Migranten‘ die Rede. Da sich die ‚Illegalität‘ allerdings ausschließlich auf die formale Frage des Aufenthaltstitels bezieht und da sich die betreffenden Personen keines Verbrechens im herkömmlichen Sinne schuldig gemacht haben, ist die im Begriff implizierte Bezeichnung der Migranten als Kriminelle unangebracht.

    Dies ist ein Näherungswert, der zwischen den Angaben der US-Zensusbehörde (ca. 800.000, Grieco 2010, S. 6, Tab. 3) und der kolumbianischen Statistikbehörde (ca. 1,2 Mio., Rojas 2006, S. 45) liegt.

    Der kolumbianische Kongress besteht aus dem Senat und dem Repräsentantenhaus. Bei den hier genannten Posten handelt es sich um Sitze in der letztgenannten Kammer (Serrano Carrasco 2003, S. 116 FN 1).
