Zusammenfassung
Psychische Störungen sind Anlass zu Behandlung, nicht Bestrafung. Unter den verschiedenen Methoden, durch die psychopathische Störungen zur Einschränkung der Freiheit einer Person unter dem Zivil- und Strafrecht führen können, stellt die Verhängung der Todesstrafe die extremste dar. Die psychiatrische Aussage, dass ein Angeklagter an einer psychopathischen Störung leidet, trägt zum Beweis des erschwerenden Faktors unveränderlicher Gefährlichkeit bei. Würde das Oberste Gericht der Vereinigten Staaten sein eigenes Prinzip anwenden, dass eine Person nicht für eine psychische Störung bestraft werden darf, und würde es die Aussage vor Gericht nicht zulassen, dass die psychische Störung eines Angeklagten tatsächlich einen erschwerenden Faktor darstellt, so könnten unziemliche psychiatrische Aussagen in bedeutendem Maße bei Verhandlungen zur Verhängung der Todesstrafe vermieden werden.
