Abstract

The New York Convention is part of Austrian law and fully applied by Austrian courts. This chapter addresses certain salient interpretation and application questions faced by Austrian courts when dealing with recognition and enforcement proceedings of foreign arbitral awards under the Convention.

    Domestic arbitral awards (i.e. such rendered by an arbitral tribunal with its seat in Austria) constitute executory titles eo ipso pursuant to Section 1 no. 16 of the Austrian Enforcement Act. Thus, there is no need for separate exequatur proceedings.
