This article discusses two situations in which mental health issues may arise in cases of wrongful detention:

  1. 1.

    Where a person who may or may not have a mental health condition is wrongfully detained in a psychiatric institution;

  2. 2.

    Where a person who does have a mental health condition is wrongfully detained in some other institution, in particular, an aliens' detention centre.
