Online-Portale zur Bewertung von Ärzten erlangen stetig größere Aufmerksamkeit und Bedeutung. Mindestens ein Viertel aller Bundesbürger nutzt auf der Suche nach einem Mediziner bzw. einer geeigneten Operations- oder Rehabilitationseinrichtung das Netz. Die aktive Nutzung von Plattformen wie www.jameda.de, www.sanego.de oder www.docinsider.de kann daher auch für Ärzte vorteilhaft sein. Ihre Datenprofile werden dort ohnehin geführt. Angesichts des bedeutenden öffentlichen Interesses an Information über Gesundheitsleistungen ist dies auch rechtlich zulässig. Auch daran, dass die Online-Bewertung anonym erfolgt, ist nach Ansicht des Bundesgerichtshofs nichts auszusetzen. Jedoch müssen Ärzte nicht alles in Internetportalen über sie Veröffentlichte widerspruchslos hinnehmen. Sie können im Einzelfall die Löschung solcher Beurteilungen verlangen, die statt grundrechtlich geschützter Meinungsäußerungen falsche Tatsachenbehauptungen oder sog. Schmähkritik beinhalten. Hierzu ist ein sachlich und rechtlich fundierter Vortrag notwendig. Auch die Erstattung einer Strafanzeige ist möglich.

Abstract

Online portals for rating of physicians continuously receive a great deal of attention and importance. At least one quarter of all German citizens use the network when searching for a doctor and suitable institutions for surgery or rehabilitation. The active use of platforms, such as jameda.de, sanego.de and docinsider.de can, therefore, also be advantageous for physicians. Their data profiles are channelled there anyway. In view of the considerable public interest in information on healthcare services, this is legally allowed and also in the opinion of the Federal Court of Justice, there are no reasons not to allow this because the on-line evaluation is anonymous; however, physicians do not have to put up with everything which is published about them in Internet portals without recourse to rebuttal. In individual cases they can demand the deletion of evaluations which contain false allegations or even abusive criticism instead of opinions voiced within the protection of basic rights. For this a factual and legally based argument is necessary and even the pressing of criminal charges is possible.
