Identifying competitive intelligence of collaborative intellectual property alliances: analytic platform and case studies

Abstract

This study provides an analytic platform for investigating and comparing the competitive advantage of multiple patent pools owned and operated by industry alliances. An integrated patent valuation measure uses seven indicators to evaluate patent quality in the patent pool. Licensee financial performance is also evaluated to show the financial benefits brought upon by the patent pool’s license scheme. Combining the results of two evaluation perspectives, the system provides a multi-dimensional measure of competitive advantage among multiple patent pools. This study takes two sets of competing optical disc related patent pools (DVD 3C vs. DVD 6C; Premier BD vs. One-Blue), as the empirical case to test the proposed analytic platform. The analytic platform provides a historical and current evaluation of patent pool portfolios for patent owners, potential licensees, investors and patent pricing consultants based on a rational assessment of each pool’s patent quality and the financial outcomes for licensees.
