Zusammenfassung
Trotz der Versuche, Einwanderung zu regulieren und aufenthaltsbeendende Maßnahmen durchzusetzen, werden Städte und Gemeinden auch von Migrant*innen bewohnt, die über keinen legalen Aufenthaltsstatus verfügen. Daraus resultieren besondere Handlungserfordernisse für die Kommunalpolitik, z. B. bei der Wohnraumversorgung, dem Zugang zu medizinischer Behandlung und zur schulischen Bildung. Die Frage nach einem angemessenen Umgang mit Personen ohne gesichertes Aufenthaltsrecht verweist dabei auf ein gesamtgesellschaftliches sowie auf ein kommunalpolitisches Konfliktfeld. Das Konzept der ‚Sanctuary Cities‘ oder ‚Solidarity Cities‘ stellt eine eigenständige kommunalpolitische Antwort, insbesondere nordamerikanischer und britischer Städte, auf diese Herausforderungen dar; eine Antwort, die auch für deutsche Städte relevant ist.

Agnes Czajka (2012) akzentuiert die Heterogenität der Akteur*innen, Motive und Praktiken, die mit dem Etikett ‚sanctuary practices‘ oder ‚sanctuary movement‘ belegt werden. In Deutschland sind diesbezüglich v. a. die Praktiken der Kirchenasyle bekannt geworden (Just 2013; BAG Asyl in der Kirche 2015). Daneben haben sich in Städten und Gemeinden aber auch vielfältige säkulare Projekte und Initiativen entwickelt. Für Sanctuary-City-Ansätze in verschiedenen Erdteilen, siehe Bauder 2022.

Allerdings existiert ist den USA inzwischen ein Temporary Protected Status (TPS), der einen ähnlichen Charakter wie Duldungen hat, jedoch nur für bestimme Herkunftsländer zugeteilt wird (National Immigration Forum 2021).

In Kanada und den USA existiert – anders als in Deutschland – eine kommunale Polizei, die nicht für die Durchsetzungen der Einwanderungsgesetzgebung zuständig, sondern v. a. mit dem Schutz der Bürger*innen vor Gewalt- und Eigentumsdelikten beauftragt ist. Daneben bestehen für die Durchsetzung aufenthaltsrechtlicher Vorgaben besondere nationalstaatliche Institutionen (Wurtzbacher 2008, S. 67–94).

In Reaktion auf den Versuch der Trump-Administration, Abschiebemaßnahmen gegen Undokumentierte durchzusetzen, erklärte dann z. B. der Leiter der Polizeibehörde des Bezirks von LA County 2019, dass ICE Mitarbeiter*innen in Einwanderungsangelegenheiten keinen Zutritt zu Bezirksgefängnissen, Gerichten und Polizeistationen hätten (Macias 2019).

Dies wurde bei einem Forschungsaufenthalt des Autors in Toronto im Mai 2015 als massive Kritik an der Inanspruchnahme des Konzepts durch die kommunalen Behörden eingefordert.
