Zusammenfassung

Dieser Beitrag zeigt auf, dass der amerikanische administrative Staat in der Tradition der frühneuzeitlichen europäischen Polizeiwissenschaft gesehen werden muss. Die klare Trennlinie zwischen Polizeistaat und Rechtsstaat, die von der liberalen politischen Theorie, welche auch für die amerikanische Verfassung Pate stand, gezogen wurde, und die auch heute noch von konservativen KritikerInnen bedient wird, erweist sich bei näherer Untersuchung als hochgradig problematisch. Der administrative Staat ist demnach gleichermaßen Rechtsstaat, Polizeistaat und Sozialstaat. Darüber hinaus legt dieser Beitrag dar, dass sich der administrative Staat in den USA vor dem Hintergrund einer Krise des frühen industriellen Kapitalismus formierte und seither sowohl eine Krisenlösung als auch ein Krisenproblem darstellt, das auf das Engste mit der ökonomischen, sozialen und politischen Krisenhaftigkeit des Kapitalismus verwoben ist.
