Legislation, Policies, and Practices Against Trafficking in Human Beings: The Case of Kosovo

Abstract

Kosovo is currently classified as a tier 2 source and destination country for female, male, and child victims of sexual exploitation and forced labor. Over the years, increasing efforts have been observed in the fight against trafficking in human beings, and anti-trafficking responses have been initiated and developed at various levels. However, the country is not yet found to be fully compliant with the minimum standards for the elimination of trafficking, and important challenges remain in the investigation, prosecution, and sentencing of trafficking cases. Within this context, this chapter aims to provide an overview of the unique situation of human trafficking in Kosovo. For that purpose, the Kosovo national situation, including information on the legislative and institutional framework, is briefly presented. Insights and reflections drawn from a Training Needs Assessment, not only examining the training and capacity-building needs of the local judicial and law enforcement authorities but also reflecting the fragilities of the rule of law in the country, are presented and used to underline significant aspects of the local anti-trafficking responses. Finally, the lessons learned and the experiences acquired from the case of Kosovo are synthesized to convey potential implications, recommendations, and future directions.
