Summary
One key methodical approach to scientifically founded predictions of criminal reoffence is based on empirical knowledge of offenders’ recidivism and factors associated with recidivism. By systematising this knowledge, structured risk assessment instruments render these experiences usable for predictive purposes. Based on them, individuals can be classified as belonging to a group of offenders with a known recidivism rate. These instruments are most common in English-speaking countries, but there is also a growing interest in Germany and they are increasingly being used for the drawing-up of expertises, in the penal system, and in cases of hospital treatment orders.
The aim of the present article is to provide an overview of the instruments currently in use, assess their empirical proof of value, and to check whether they could possibly be applied to German samples. Next to traditional actuarial approaches, we included instruments for the so-called „risk-needs-assessment“, instruments for the prediction of violence, for the identification of specific high-risk-offenders, and for the prediction of reoffending of sexual offenders and juvenile offenders.
In summary, one can say that a number of empirically well-grounded instruments with repeatedly proven predictive validity exists. Wherever German samples were used to test these instruments, the precision of their predictions usually matched international findings. When keeping in mind their advantages and limitations, structured risk assessment instruments are a sensible methodical complement in the context of criminal prediction but cannot replace the individual-focused examination in individual cases.
Zusammenfassung
Ein wichtiger methodischer Zugang zu wissenschaftlich fundierten Kriminalprognosen führt über empirische Erfahrungen mit der Rückfälligkeit von Rechtsbrechern und hiermit zusammenhängender Merkmale. Standardisierte Prognoseinstrumente machen diese Erfahrungen für prognostische Zwecke nutzbar, indem sie diese systematisieren und auf ihrer Basis eine Zuordnung der zu beurteilenden Person zu einer Tätergruppe mit bekannter Rückfallwahrscheinlichkeit ermöglichen. Solcherart konstruierte Instrumente sind vor allem im englischsprachigen Raum verbreitet, doch wächst auch in Deutschland das Interesse und sie werden zunehmend bei Begutachtungen sowie im Straf- und Maßregelvollzug eingesetzt. Anliegen des Beitrags ist es, eine Sichtung der derzeit gebräuchlichen Instrumente vorzunehmen, den Grad ihrer empirischen Bewährung zu bewerten und die Übertragbarkeit der meist im Ausland entwickelten Verfahren auf deutsche Zielgruppen einzuschätzen. Einbezogen wurden neben klassischen statistischen Verfahren auch Instrumente zum so genannten „Risk-Needs-Assessment“, zur Gewaltprognose, zur Identifikation spezieller Hochrisikogruppen, zur Rückfallprognose bei Sexualstraftätern sowie für junge Tätergruppen. Zusammenfassend lässt sich feststellen, dass eine Reihe empirisch gut fundierter Instrumente existiert, deren Vorhersagevalidität wiederholt belegt wurde. Soweit die im Ausland entwickelten Instrumente auch an deutschen Stichproben untersucht wurden, erzielten sie meist vergleichbare Vorhersageleistungen und scheinen insofern auch hierzulande anwendbar. In Abwägung ihrer Vorteile und ihrer Grenzen stellen standardisierte Prognoseinstrumente eine sinnvolle methodische Ergänzung im Rahmen der Prognosebeurteilung dar, können aber eine individuumszentrierte Einzelfallbetrachtung nicht ersetzen.
