Zusammenfassung
Fieldings Tätigkeit als Friedensrichter, Justizreformer und Polizei-Pionier wird vor dem Hintergrund einer generellen verwaltungs- und rechtsgeschichtlichen “modernization” im 18. Jahrhundert dargestellt. Fieldings widersprüchliche Anschauungen (Benevolismus vs. Disziplinierung) erweisen sich als Teil der allgemeinen historischen Entwicklungsrichtung hin zu einer Verinnerlichung sozialer Kontrolle.
Abstract
Fielding’s activities as Justice of the Peace, legal reformer, social pamphletist and police pioneer are sketched against the background of a universal administrative and juridical “modernization” in the 18 th century. Fielding’s contradictory attitude (benevolence vs. discipline) proves to be consistent with a general historical tendency towards an internalization of social control.
