Summary
Surgical indication is determined exclusively by medical points of view. It is the task of the law to make sure that the surgeon makes his decision with the necessary diligence. The surgeon is only liable for diagnostic and therapeutic errors leading to failures in treatment if those are due to malpractice. It is important to carefully consider benefits and risks from the patients view; the forensic risks for the surgeon must not be included in his decision to operate.
Zusammenfassung
Die chirurgische Indikation bestimmt sich ausschließlich nach medizinisch-fachlichen Gesichtspunkten. Aufgabe des Rechts ist es, sicherzustellen, daß der Chirurg seine Entscheidung mit der gebotenen Sorgfalt trifft. Für diagnostische und therapeutische Irrtümer, die zum Behandlungsmißerfolg führen, haftet der Chirurg nur, wenn sie auf einer schuldhaften Fehlleistung beruhen. Abzuwägen sind Nutzen und Risiken aus der Sicht der Patienten; nicht einzubeziehen ist in die Indikationsentscheidung das forensische Risiko des Chirurgen.
