Abstract

In the first interview in this chapter, Dr. Mohammad Hashim Kamali provides a thorough history and discussion of Maqasid al-Shari’ah. After describing their scriptural origins, Kamali turns to discuss how classical Islamic jurists further developed the theory. He gives a detailed explanation of the development of each maqsad and the three levels of necessity within the elements of each. The primary level, which refers to the goals that are central to the survival of society, are the daruriyyat (necessities), while hajiyyat (needs) are important in making life easier and relieving burdens, and tahsiniyyat (refinements) include the goals leading to the perfection and beautification of the social order and of human behavior. He concludes by discussing the contemporary implications of the Maqasid theory for governance and public policy.
