Abstract

This chapter will address the issue of nationality-based employment discrimination in Israel, focusing on the failure of the current legal framework to effectively address this phenomenon in relation to Arab Palestinians in Israel (hereafter Palestinians). The first three sections of the chapter will briefly present the problem, the existing legal framework and the enforcement failure, and analyze the factors that contribute to the ineffectiveness of the law. The fourth section will sketch an alternate theoretical framework for regulating nationality-based employment discrimination, and describe ways in which these strategies can be used by the newly established Israeli Employment Equality Commission to complement existing enforcement methods. The fifth and final section will address practical steps needed to enable the commission to fully realize its potential, including strengthening the commission and altering the legal framework under which it operates.
