Abstract

One of the most important agendas of the transition from a planned economy to a market-based economy is the separation of the company from the state. In this respect it must be said that the process in China is still ongoing. As mentioned in the Preface to this book, a slow and gradual positive transformation of institutions has been seen to date. However, those aspects of state that remain continue to have a negative impact on the corporate sector. The power abuse by the state as concentrated owner is a common phenomenon in China and is seen as a serious problem by researchers in both law and economics. This chapter and chapter 6 both approach this problem with legal and economic theories.
