The Onto-Anthropological Foundation of Criminal Law in Brazil

Abstract

The influence of Portuguese criminal law is perceived in the very first Brazilian penal laws. In recent decades, the dialogue between the two countries has intensified and allowed for important theoretical developments. The onto-anthropological foundation of criminal law developed in Portugal by José de Faria Costa has gained increasing acceptance in Brazil and is shown today as an alternative to criminal law with a functionalist orientation. However, there are no studies concerned with this important presence in the Brazilian criminal law. This chapter focuses on the lack of studies on the presence of the onto-anthropological foundation in Brazil and aims to answer the following guiding question: What is the main contribution of the onto-anthropological foundation to contemporary criminal law?
