Abstract

My comment will discuss some points concerning the investigation into the debtor's assets in civil enforcements proceedings inspired by the insightful report of Prof. Krans. I will confine myself to outline, without referring to specific national legal systems, the key requirements or elements which a reasonable enforcement system should meet in this area.
