Investigation Report on Administrative Litigation Government Information Disclosure Cases in Ningbo City, Zhejiang Province

Abstract

This report takes the administrative litigation government information disclosure cases accepted and closed by the Intermediate People’s Court of Ningbo City, Zhejiang Province between 2011 and 2018 as samples and, through the analysis of the basic situation and main characteristics of the cases, explores the problems currently existing in the government information disclosure work of administrative organs and their causes. The report shows that, in recent years, the number of administrative litigation government information disclosure cases accepted by the courts in Ningbo has been generally on the rise, with most of these cases involving frequently occurring administrative acts, and the number of closed cases has increased drastically; the losing rate of administrative organs in these cases is higher than the average; and the phenomenon of abusing the right of application or litigation rights by some applicants is prominent. The causes of these problems include relatively imperfect statutory laws, defects in the mechanisms for information disclosure work of administrative organs, and unfavorable external environment of government information disclosure. In light of this situation, China should further standardize the government information disclosure work, enhance the capacity of administrative organs for providing law-based services, and ensuring the comprehensive implementation of the government information disclosure system.
