Abstract
On November 22 1990, in closing a symposium dedicated to Boissonade and the reception of French law in Japan, Dean Carbonnier stated that it was “not far-fetched to imagine a time when the contributions of Boissonade to Japan will be reciprocated by the principles of Japanese law, that the French will borrow” (Carbonnier, 1991). Nevertheless, even though the sources of Japanese law, as well as their legislative system are becoming more and more similar to those in Europe, Japanese institutions continue to function in such a dissimilar manner that the period to which Carbonnier alluded has not yet arrived.
I would like to thank Madame Rubellin-Devichi for the inevaluable help given during the writing of this manuscript.
