Abstract
This contribution provides information on the new Austrian Juvenile Justice Act, the practice of out-of-court offense compensation embodied within this law, and the problems that have evolved from this practice. For a better understanding of their genesis, a short review of the law-making process is presented, starting with a description of the most important features characterizing Austria’s Juvenile Justice system and providing the ground for a fundamental law reform, that is, the principle of legality, the restriction on mandatory prosecution, and the specific character of the probation service. The second section contains a discussion of some recent data compiled from the records of the state prosecutor’s offices. Lastly I will give some information on research plans and on first results of a workgroup in Vienna that has undertaken the task of designing a professional profile of the mediator, or, in more general terms, the social worker within the Austrian ATA (Außergerichtlicher Tatausgleich).
