Abstract
A State has jurisdiction to prosecute and punish crimes and offences committed on board aircraft within the area of its sovereignty, which also includes the air space above its territory (according to Article 1 of the Chicago Convention of 1944). However, it is questionable whether a State will wish to exercise this jurisdiction under all circumstances, particularly when its interests are not harmed in any way whatsoever. In the case of a crime committed on board an aircraft over French territory during a flight from the United Kingdom to Italy, for example, there will be very little inclination to commence legal proceedings in France in connection with such a crime, unless French interests are affected.
