Abstract

There is much uncertainty and difference of opinion among authorities on international law concerning the exact meaning and extent of the expression „denial of justice“. It has been the great merit of the Claims Commission under the Presidency of van Vol­lenhoven to have expressed itself very clearly and fully on this subject. In particular it rendered three penetrating and important opinions in the field of „denial of justice”: one dealing with the problem as to what kind of acts can be considered as such 1); one dealing with the standards that should be applied to determine the existence of a denial of justice 2); and the third dealing with the theoretical basis for so-called „indirect“ liability of a Govern­ment in cases of a failure to punish a wrongdoer 3) 4).
