Zusammenfassung
Entwicklungen nach 1918, wie Errichtung eines neuen Staatssystems in Rußland, Entstehung neuer Staaten in Mitteleuropa, usw., stellten zahlreiche innerstaatliche Gerichte wiederholt vor die Frage, welche Rechtsstellung einer effektiven aber nichtanerkannten Regierungsgewalt zukomme. Wiederum ergab sich die Frage nach der Anwendung des (1) Anerkennungs- und (2) Effektivitätsgrundsatzes, der Bindung der Gerichte an die Nichtanerkennungspolitik ihrer Regierungen bzw. der Unabhängigkeit der Gerichte, an die faktische Existenz eines Staatsgebildes rechtliche Folgen zu knüpfen. Beide Grundsätze kamen zur Anwendung, und zwar abwechselnd auch innerhalb ein und derselben innerstaatlichen Judikatur. Hieraus ergibt sich ein uneinheitliches Bild, das sowohl von Rechtsfrage zu Rechtsfrage als auch von Staat zu Staat uneinheitlich ist. Die unten angeführten Beispiele gliedern sich in folgende Hauptgruppen:

Hoheitsakte, territoriale und extraterritoriale Geltung der Gesetze einer nichtanerkannten Staatsgewalt;
-
b.)
Konflikt zwischen zwei Regierungsgewalten die den Herrschaftstitel für ein und dasselbe Staatsgebiet geltend machen;
-
c.)
Prozeßfähigkeit: Klagerecht und Prozeßimmunität;
-
d.)
Die Rückwirkung einer völkerrechtlichen Anerkennung auf die Rechtsstellung eines nichtanerkannten Staats.
