Abstract
The purpose of this paper was to address the essence of Caspian legal regime and dynamics of Kazakhstan’s position. The paper approached the issue by analysing the elements of the Caspian legal regime with an emphasis on the most controversial issues of seabed and delimitation. In addition, it deals with recent developments in the process of establishing a new legal regime, including the Moscow Treaty of 1998. The finding indicated that Kazakhstan has consistently proposed the delimitation of the Caspian shelf, freedom of navigation and fishing for all coastal states as well as a joint system of environmental security. The results suggest that more attention should be paid to the main mutual interests of all Caspian states — security and sustainable economic growth of the region. In addition, Kazakhstan and Russia exempla an acceptable compromise for creating a new Caspian legal regime.

Azerbaijan initially awarded the Kyapaz/Serdar field to Russian companies Lukoil and Rosneft in July 1997. After the negative Turkmenistan’s reaction Russian Government denounced the contract. The Turkmenistan’s Competent Body was reported to include Serdar/Kyapaz in the tender, but then removed it. Moreover, after the request of Iran, Turkmenstan removed other three blocks straddling the Turkmen-Iranian border. It was reported that these blocks would be developed jointly by both countries.

There is a problem of Russian ratification of agreements and their respective amendments on the Caspian Pipeline Consortium.
