Abstract
Judicial reasoning, whether it is deployed for the formulation of the aims of legislative reforms, in the preparation of a judicial decision, the drawing up of a contract, concluding remarks or for a defence plea must carry with it the convictions of the people to whom it is addressed. It exposes and articulates the arguments, the justifications and the reasons for a decision. Often attached to a purely legal argument is a statement of the extra-judicial motives that underpin the decision. Besides the normative prescriptions, the legislator thus shows motives in the statement, indeed, even within the law, general measures expressing the aims of the reform. The use of consensual notions such as dignity, solidarity, equality allow for societal acceptability. Under the pretence of this general objective exhibited by the legislator, are placed normative measures, which are attributed with the legitimacy of this intention. Similarily, one must note the jurisprudential trend to move away from judicial syllogism to find the motives of the decision out with the law and to present them as such.
