Zusammenfassung

Wenn eine Ethikrichtlinie durch Arbeitsvertrag oder Zusatzvereinbarung eingeführt wird, richtet sich die Zulässigkeit von Richtlinieninhalten maßgeblich nach der AGB-Kontrolle gemäß § 305 ff. BGB. Bevor jedoch näher auf die Voraussetzungen und Einzelheiten einer solchen Prüfung eingegangen wird, bedarf es im Vorfeld einer kurzen Betrachtung, inwieweit die AGB-Kontrolle überhaupt im Arbeitsrecht Anwendung findet.
