Zusammenfassung

Nach ständiger Rechtsprechung des BAG haben Arbeitnehmer einen Anspruch auf Entfernung einer Abmahnung aus der Personalakte, sofern diese rechtswidrig vom Arbeitgeber erteilt wurde. Die Rechtsprechung leitet den Anspruch aus dem Allgemeinen Persönlichkeitsrecht des Arbeitnehmers her und stützt diesen auf die §§ 12, 862, 1004 BGB analog.
