ZUSAMMENFASSUNG
Das Europarecht und die EU-Organe nehmen immer größeren Einfluss auf die Rüstungsbeschaffung der EU-Mitgliedstaaten. Obwohl weder im Vertrag über die Europäische Wirtschaftsgemeinschaft von 1957 noch in dessen Fassungen von Maastricht, Amsterdam oder Nizza noch im nunmehr gültigen ‚Vertrag über die Arbeitsweise der Europäischen Union (VAEU)‘ von Lissabon eine Ermächtigungsgrundlage für die Integration im Verteidigungsbereich zu finden ist, liegt nunmehr sogar eine Richtlinie zur Beschaffung im Rüstungs und Sicherheitsbereich vor. Die Richtlinie 2009/81/EG war bis zum August 2011 in die Rechtsordnungen der Mitgliedstaaten umzusetzen. In diesem Beitrag wird die neue EURichtlinie zur Beschaffung im Rüstungs- und Sicherheitsbereich kurz kritisch erörtert. Dabei wird zunächst auf die Grundlagen im primären EU-Recht eingegangen. Während es noch zu früh ist, die Erfolgsaussichten der neuen Richtlinie erschöpfend zu behandeln, kann doch schon jetzt von einer Umwälzung gesprochen werden. Ein bisher von der Politik bestimmter Bereich staatlichen Handelns wird nunmehr verrechtlicht, ausgelöst durch das EU-Recht.
