Fähigkeiten und Funktionsweisen als „Währung der Gerechtigkeit“ für Kinder

Zusammenfassung

Der Fähigkeitenansatz scheint trotz einiger Schwierigkeiten, insbesondere hinsichtlich der sogenannten „agency assumption“, die davon ausgeht, dass die Gerechtigkeitsadressat:innen autonom und reflektiert über ihr Leben entscheiden, eine geeignete Basis für die Konzeptualisierung von Gerechtigkeit für Kinder abzugeben. Damit sind zumindest drei Fragen verbunden, die bis dato in der Debatte noch nicht ausreichend geklärt worden sind: Warum und welche Fähigkeiten (capabilities) bzw. Funktionsweisen (functionings) sollten als Währung der Gerechtigkeit (currency of justice) für Kinder gelten? Nach welchen Prinzipien oder Regeln sollten diese zwischen Kindern verteilt werden bzw. auf welches Maß dieser Fähigkeiten oder Funktionsweisen haben Kinder einen Anspruch der Gerechtigkeit? Wer ist für diese gerechte Verteilung verantwortlich, also welche Gerechtigkeitspflichten lassen sich auf Seiten von Personen und Institutionen ausmachen? Wir werden uns in diesem Beitrag auf die erste Frage konzentrieren und eine Antwort skizzieren, die sich als Lösung eines zentralen theoretischen Problems des Fähigkeitenansatzes versteht. Kurz zusammengefasst besagt diese, dass Funktionsweisen die adäquate Währung der Gerechtigkeit für Kinder sind, im Laufe der Kindheit jedoch Fähigkeiten an Bedeutung gewinnen.
