Abstract
The Plaintiff shipowner brought a claim against the Defendant for losses caused by the Defendant’s application for preservation of maritime claims, which resulted in the Plaintiff’s bank account being frozen. The Plaintiff and the Defendant contracted a time charter party where the Defendant was to charter the Plaintiff’s ship. During the performance of the charter party, demurrage occurred when the vessel refused to follow the Defendant’s navigational orders. As a result, the Defendant filed an application for preservation of maritime claims. However, the Defendant could not obtain the Plaintiff’s correct business registration address because this information was not disclosed in the charter party.
