Zusammenfassung
La Corte Costituzionale Federale tedesca (CCF) ha accettato gli elementi essenziali della sovranazionalità sviluppati dalla giurisprudenza comunitaria. Tuttavia, la CCF ha individuato tre riserve: l’esistenza di una sufficiente tutela dei diritti fondamentali a livello sovranazionale (Solange I 1974, Solange II 1986), il divieto di azioni ultra vires da parte dell’UE (Maastricht 1993; Mangold 2010) e l’inviolabilità dell’identità costituzionale, derivata dalla clausola di eternità dell’articolo 79.3 della Legge fondamentale (Lisbona 2009). La CCF si basa sul concetto di “responsabilità per l’integrazione” (art.23 Legge fondamentale). La Convenzione europea dei diritti dell’uomo, che in Germania ha solo il rango di una legge federale ordinaria, è, secondo la giurisprudenza della CCF (Görgülü 2004), determinante per l’interpretazione dei diritti fondamentali tedeschi.
Abstracts
The German Federal Constitutional Court (FCC) has accepted the essential elements of supranationality developed by the ECJ case law. However, the FCC has identified three reservations: the existence of sufficient protection of fundamental rights at supranational level (Solange I 1974, Solange II 1986), the prohibition of ultra vires actions by the EU (Maastricht 1993; Mangold 2010) and the inviolability of constitutional identity, derived from the eternity clause of Article 79.3 of the Basic Law (Lisbon 2009). The CCF is based on the concept of “responsibility for integration” (art.23 Basic Law). The European Convention on Human Rights, which in Germany has only the status of an ordinary federal law, is, according to the case law of the FCC (Görgülü 2004), decisive for the interpretation of German fundamental rights.
