Der Zivilprozess in Kontinentaleuropa

Zusammenfassung

Nach dem Scheitern der revolutionären Experimente Ende des achtzehnten Jahrhunderts wurde die französische Zivilprozessordnung von 1806 zum Vorbild für Reformen in Europa, auch wenn sie für Frankreich selbst eher gemäßigt war und in die Fußstapfen des älteren Rechts trat. Der französische Einfluss muss nicht bedeuten, dass Länder in ganz Europa sklavisch dem französischen Beispiel folgten, sondern vielmehr, dass das französische Recht den Hintergrund der Reformdebatte im Europa des neunzehnten Jahrhunderts bildet. Weil es der österreichischen Zivilprozessordnung von 1895 gelang, die Zivilprozesse in Österreich zu beschleunigen und den Bedürfnissen des Wohlfahrtsstaates gerecht zu werden, wurde sie zum Hauptmodell für Reformen im gesamten zwanzigsten Jahrhundert. Was die Forschung anbelangt, so sind vergleichende historische Studien nach wie vor selten, und ein Haupthindernis ist das Fehlen eines angemessenen gemeinsamen Instrumentariums für die Erforschung des Zivilprozesses in Europa.
