Abstract

In Germany the law in relation to non-competition clauses is regulated by the Commercial Code (Handelsgesetzbuch, HGB) and applies both during the term of the employment relationship and after its termination (provided there is a contractual post-employment non-competition provision). The relevant provisions of the Commercial Code are mandatory and must be observed.
