Zusammenfassung
Die staatliche Verwaltung des öffentlichen Kraftwagenverkehrs1 kam auf eigenartige Weise zustande. Die Kraftverkehrsbetriebe hatten weder ein Monopol, noch hätte der wohl rasch stattfindende Zusammenschluß2 ihnen in Kürze eine monopolistische Stellung von solcher Bedeutung gebracht — wenigstens nicht in der Mehrzahl der Staaten —, daß es für den Staat aus diesem Grunde notwendig gewesen wäre, in die Gewerbefreiheit des Einzelnen einzugreifen. Auch die Verkehrskunden zeigten kein besonderes Interesse für die Regulierung des Kraftwagenverkehrs, wie sie es bei anderen Verkehrsmitteln, insbesondere bei den Eisenbahnen, hatten; ja, viele sprachen sich sogar ausdrücklich dagegen aus, weil sie im freien Wettbewerb des Kraftwagenverkehrs die beste Gewähr für niedrige Beförderungspreise und gute Dienstleistungen sahen. Der Ruf nach Regulierung oder Beaufsichtigung durch die Staaten kam hauptsächlich aus dem eigenen Lager, von einer Gruppe von Kraftverkehrsunternehmern und von den Eisenbahngesellschaften. Es waren die Kraftverkehrsbetriebe, die fahrplanmäßig und regelmäßig zwischen bestimmten Verkehrspunkten Dienstleistungen an allen Personen unter gleichen Bedingungen anbieten, die sogenannten common carriers oder öffentliche Kraftverkehrsunternehmer1, die eine Regulierung verlangten.
