Zusammenfassung und Schlussfolgerungen

Kontrolle von Mindestlöhnen

Zusammenfassung

Hier fassen wir die zentralen Erkenntnisse aus den einzelnen Teilen unserer Studie zusammen und gehen ausführlich auf Stärken und Schwächen des Kontrollsystems sowie auf den Stand der bisherigen Durchsetzung und Einhaltung von Mindestlöhnen in Deutschland ein. Aus der Gesamtschau der Ergebnisse unserer Untersuchung sowie Erkenntnissen aus der umfangreichen internationalen Literatur zu Compliance und Enforcement haben wir Vorschläge zur Verbesserung der Kontrolle und Einhaltung von Mindestlöhnen in Deutschland entwickelt. Ansatzpunkte bestehen u. E. insbesondere in einer Stärkung der Selbstkontrollen durch die Sozialpartner, mehr Verantwortung an der Spitze der Wertschöpfungsketten sowie in einer Stärkung des Self-Enforcement durch transparente und einfache Regelungen. Notwendig sind auch eine Organisationsreform der Finanzkontrolle Schwarzarbeit (FKS), eine Zusammenlegung oder Kooperation der beiden Fahndungsdienste des Zolls sowie eine gezieltere Unterstützung von Beschäftigten bei der Durchsetzung vorenthaltener Mindestlohnansprüche.
