Ein Mangel ist juristisch betrachtet eine besondere Form der Leistungsstörung. Zwei Leistungen stehen in einem Gegenseitigkeitsverhältnis: Eine der Vertragsparteien bietet eine bestimmte Planungsleistung oder Bauleistung an. Als Gegenleistung verspricht die andere Partei Honorar oder Werklohn.
