Zusammenfassung
Die Europäische Union (EU) operiert ‚zwischen‘ ihren Mitgliedstaaten und globalen transnationalen Strukturen (vgl. Kjaer 2007, S. 367–378). Ihre Rechtsordnung ist weder durch eine nationalstaatliche Hierarchie noch durch eine radikale Heterarchie, einem wesentlichen Merkmal globaler Rechtsstrukturen, gekennzeichnet (vgl. Fischer-Lescano/Teubner 2004; 2006; 2007). Vielmehr ist die EU ein Hybrid, der Hierarchie und Heterarchie in spezieller Weise verbindet.
