Die parlamentarische Demokratie

Zusammenfassung

Die Analyse der Binnenstruktur der Parlamente fördert Erkenntnisse zu Tage, die sich nicht nur auf parlamentarische Demokratien im engeren Sinne beziehen: die Entwicklung autonomer Beratungsstrukturen war in gewaltenteiligen Systemen, wie dem Schweizer Ratssystem oder dem amerikanischen präsidentiellen System nicht unähnlich. Dennoch hat der Typ des Regierungssystems gewichtige Einflüsse auf die Arbeitsweise des Parlaments:

    Es wurden Parlamente und Legislaturen unterschieden. Das präsidentielle System mit seiner Gewaltenteilungskonzeption erscheint als eine stärker spezialisierte Legislatur. Einige Funktionen von Parlamenten, wie Repräsentation, Gesetzgebung und Kontrolle hat der Typ der Legislatur stärker ausgebildet als der Typ der europäischen Parlamente. Eine zentrale Funktion aber, wie die Wahl- und Rekrutierungsfunktion fehlt im präsidentiellen System weitgehend, weil die Exekutive von der Legislative unabhängig ist. Eine indirekte Mitwirkungsfunktion hat sich vor allem im Erfordernis der Zustimmung des Senats zu Ernennungen des Präsidenten erhalten.

    Quer zu den Typologien der Regierungsformen nach den Typen der exekutiv-legislativen Beziehungen liegt die Unterscheidung nach dem Kriterium der Durchsetzung des Mehrheitsprinzips in der Gestaltung des parlamentarischen Verfahrens. Der Pluralismus der Gesellschaft erfordert vielfach andere Logiken als die Logik des parlamentarischen Mehrheitsprinzips.
