Abstract

Portuguese law (Decree no. 553/76 of July 13, 1976) has recognized the concept of cerebral death and has accepted the current practice of organ removal by presumed consent, expressing as possible and legally acceptable any mode of opposition to that removal. That opposition is valid only when expressed in life by the possible donor. The family only has the right of expressing that opposition, they do not have the right of denying consent for any surgical act envisaging organ removal.
