Group Expertise In Legal Decision Making

Abstract

This chapter presents nine specific methods to achieve exceptional decision- making performances by trial teams, litigation departments, law firm management committees, and case selection and evaluation committees. These methods counter two common problems in group decision making – “groupthink” and “group polarization” – and incorporate the best practices of high reliability organizations and expert teams. The causes and consequences of deficient group decision making are analyzed, enabling attorneys and clients to detect likely problems before they become serious losses, and the attitudes and practices of superb decision making teams are described, informing attorneys and clients of the mindsets and actions proven to reduce decision-making errors in high risk environments.
