Auszug
Der Föderalismus beruht bekanntlich auf den Grundprinzipien der Integration und Subsidiarität. Diese Konzepte werden aber zumeist missverstanden, da die Geschichts- und Kulturbezogenheit sowie die inhärenten politischen Spannungen des Föderalismus verkannt werden. Im Folgenden möchte ich das Subsidiaritätsprinzip und seine zwei Hauptkomponenten — die instrumentelle und materiale Zentralisierung bzw. Dezentralisierung — näher betrachten und kontextualisieren. Dies wird verdeutlichen, wie eng die materiale Komponente der Subsidiarität — im Gegensatz zu der instrumentellen — mit einer ganz bestimmten Form der Integration, nämlich einer verfassungsrechtlich gestalteten Integration zusammenhängt. Die genannten Grundprinzipien verweisen zugleich auf Grundsatzfragen jedes föderalen Systems, nämlich die stetige Spannung zwischen den einander widerstreitenden Ansprüchen auf Zentralisierung und auf Dezentralisierung sowie die Problematik der damit zusammenhängenden Verfassungsintegration, die letztendlich auf der normativen Gleichstellung der Bürger verschiedener Gliedstaaten beruht.
