Auszug
Die kanadische Verfassungsgerichtsbarkeit, der Supreme Court of Canada, hat innerhalb der kanadischen Verfassungsordnung eine schwierige Stellung. Dies hat vor allem zwei Gründe: Zum einen birgt das Erbe der britisch-kanadischen Verfassungstradition ein ungewöhnlich großes Konfliktpotential hinsichtlich der Rolle einer höchsten Verfassungsgerichtsbarkeit und ihres Verhältnisses zur Legislative;1 erst im Zuge der Verfassungsreform von 1982 wurde die britisch-kanadische Konstitution durch eine konstitutionelle Grundrechtscharta ergänzt. Zum anderen ist der kanadische Supreme Court höchste Rechtsprechungsinstanz in einer sehr heterogenen Föderation, in der historisch ein starker Konflikt zwischen föderaler Autorität und dem Status der Provinzen im politischen Gemeinwesen besteht. Beide Konflikte greifen ineinander über und lassen sich nur analytisch trennen.
